Acceptance of Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Buyer,” “you”) and NodeStories (“we,” “us,” “our”), governing your access to and use of our website and the purchase of our software products.
By accessing our website, creating an account, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services or purchase our products.
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a notice on our website. Continued use of our services following any changes constitutes your acceptance of the updated Terms. Changes will not affect purchases made before the update.
Products & Software
We develop and sell plugins and software tools (“Software”) designed for use with DaVinci Resolve by Blackmagic Design. Our products are delivered exclusively as digital downloads.
PRODUCT DESCRIPTION
All products are described on their respective product pages. We make every effort to ensure product descriptions are accurate. However, we reserve the right to modify features, pricing, and availability at any time without prior notice.
DIGITAL DELIVERY
Upon successful payment, you will receive access to download your purchased Software immediately via your account or a download link sent to your registered email address. It is your responsibility to ensure your email address is correct before purchasing.
FREE PRODUCTS
Some of our products are available free of charge (“Free Software”). Free Software is provided “as is,” without warranty of any kind. We do not guarantee support, updates, or continued availability for Free Software. All restrictions listed in Section 05 (Restrictions) apply equally to Free Software.
Purchases & Payment
All prices are displayed in the currency shown at checkout. Applicable taxes may be added at checkout depending on your location in accordance with local tax laws.
Payments are processed by Paddle.com (paddle.com), which acts as the Merchant of Record for all transactions on nodestories.com. Your invoice will be issued by Paddle, not NodeStories. We do not store your payment card details on our servers. Paddle’s terms and privacy policy are available at paddle.com/legal/privacy.
You represent that you are authorized to use the payment method provided and that the billing information you supply is accurate and complete.
No Refund Policy
All sales are final. Due to the digital nature of our products, purchases are non-refundable once the download has been made available to you.
EU/EEA and UK consumers: In accordance with Paddle’s Buyer Terms, if you reside in the EU, EEA, or UK, you have the right to withdraw from your purchase within 14 days of completing your transaction. However, by completing your purchase, you expressly consent to the immediate delivery of the digital content and acknowledge that you thereby waive your right of withdrawal once the download has been made available to you, in accordance with Article 16(m) of EU Directive 2011/83/EU. If you have not yet downloaded or accessed the product, you may request a withdrawal within 14 days by submitting a request directly at paddle.net. All refund requests are processed exclusively by Paddle as Merchant of Record.
We strongly encourage you to review product descriptions, system requirements, and any available preview materials before making a purchase. If you have any questions about a product’s suitability, please contact us prior to purchase.
This does not affect your statutory rights under applicable consumer protection laws.
EXCEPTIONS
A refund may be considered only in the following circumstances, at our sole discretion:
- A technical defect renders the Software completely non-functional, and we are unable to provide a working fix within a reasonable time.
- A duplicate charge occurred due to a payment processing error.
- Applicable consumer protection law mandates a refund under specific circumstances.
To request consideration under the above exceptions, please contact us at support@nodestories.com within 14 days of your purchase, providing your order number and a detailed description of the issue — all refund requests are then handled exclusively by Paddle as Merchant of Record via paddle.net.
BUSINESS PURCHASES (B2B)
If you are purchasing the Software on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these Terms. Purchases made by business entities are not subject to consumer protection legislation, including EU Directive 2011/83/EU. No right of withdrawal applies to business-to-business transactions.
License Grant
Upon purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on up to 2 (two) devices that you personally own or control, solely for your personal or commercial creative work.
This license is granted to you personally and may not be shared, sold, transferred, or sublicensed to any other individual or entity.
Restrictions
You may not, under any circumstances:
- Redistribute, resell, sublicense, rent, or transfer the Software to any third party;
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Software;
- Remove, alter, or obscure any proprietary notices, labels, or markings on the Software.
- Use the Software to develop competing products or services.
- Share your download link or account credentials with others.
- Use the Software in any manner that violates applicable laws or regulations.
Any breach of these restrictions will result in immediate termination of your license, without refund, and may result in legal action.
Compatibility & System Requirements
Our Software is designed for use with DaVinci Resolve. Each product page specifies the minimum required version of DaVinci Resolve and supported operating systems (macOS/Windows). It is your responsibility to verify compatibility before purchasing.
We do not guarantee compatibility with future versions of DaVinci Resolve or operating system updates, though we endeavor to provide updates where feasible. We are not affiliated with Blackmagic Design. Our Products and Software are not supported or certified by Blackmagic Design.
Incompatibility with your system configuration is not grounds for a refund. Please verify requirements before purchase.
Support & Updates
We provide technical support for our products via email at support@nodestories.com. We aim to respond within 3–5 business days.
Updates to purchased products, when released, will be made available to existing customers at no additional charge for the same major version. We reserve the right to charge for major version upgrades.
We reserve the right to discontinue support for older versions of the Software or for Software incompatible with significantly updated host applications.
Intellectual Property
All Software, including but not limited to code, graphics, interfaces, documentation, and branding, is the exclusive intellectual property of NodeStories and is protected by applicable copyright and intellectual property laws.
Purchasing a license does not transfer ownership of the Software or any intellectual property rights to you. You receive only the limited license described in Section 05.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall NodeStories be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business goodwill, arising from your use of or inability to use the Software.
Our total liability for any claim arising out of or relating to these Terms or the Software shall not exceed the amount you paid for the applicable Software in the twelve (12) months preceding the claim.
The Software is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland.
If you are a consumer within the European Union, you may seek out-of-court dispute resolution through approved Alternative Dispute Resolution (ADR) bodies. A list of certified ADR entities in EU member states is available at consumer-redress.ec.europa.eu.
